The Tribunal and NSW Fair Trading
Relationship between the CTTT and NSW Fair Trading
NSW Fair Trading and the CTTT are separate organisations that offer very different services. The CTTT’s role is to conciliate and adjudicate disputes by making final, binding and enforceable orders. NSW Fair Trading can investigate complaints and also offers a mediation service to try and resolve complaints. It cannot, however make enforceable orders between two parties. This separation of roles is very important because the CTTT is an independent body and if it were to investigate complaints, it would lose this independence and therefore its ability to deliver justice impartially.
