Privacy
The NSW Consumer, Trader and Tenancy Tribunal (CTTT) is committed to maintaining your privacy. Although the Privacy and Personal Information Protection Act 1998 (NSW) ("the Act") does not apply to the CTTT when exercising judicial functions, the CTTT does endeavour to comply with the spirit of the Act. The CTTT will not collect any more information than is necessary for it to fulfill its functions, nor will it disclose your personal information to anyone without your consent unless legally permitted or required to do so, or it suspects you may have used the website unlawfully.
The CTTT will require anyone whom it engages to collect, store or use personal information for them to comply with the information protection principles.
Personal information on CTTT applications
- All information contained in an Application to the CTTT is provided to all other parties and this includes home, business phone and email details. All supporting documentation must also be supplied to the other party.
- The CTTT routinely publishes information about the cases it hears. This is done in two ways:
- Daily hearing lists are published on the CTTT website
- CTTT decisions with written reasons are published on Austlii
- The privacy of personal information is important to the CTTT. The CTTT collects personal information to register and adminster Applications and make decisions about disputes. The Chairpersons Direction CD 2009-1 (PDF size: 32kb) outlines procedures which apply to the removal or anonymisation of personal information contained in published written reasons and reserved decisions.
- A party may write to the Registrar requesting the removal of personal details from the Application, prior to the CTTT forwarding to the other party. This request will only be granted in exceptional circumstances such as personal safety reasons.
What information do we collect?
When you look at the pages of our website, our computers automatically record information that identifies, for each page accessed:

The IP (Internet Protocol) address of the machine which has accessed it

Your top-level domain name (for example .com, .gov, .au etc)

The address of your server

The date and time of your visit to the site

The pages accessed and documents downloaded

The previous site

The type of browser and operating system you have used.
We extract and publish aggregated information about usage patterns from this information. No attempt is made to identify users or their browsing activities except, in the event of an investigation, where a law enforcement agency may lawfully inspect the service provider's logs.
Except in the circumstances as set out above, the CTTT will not disclose or publish information, which identifies individual machines, or potentially identifies sub-groupings of addresses, without consent.
The CTTT reserves the right to gather more extensive information than stated above in cases of any detected activity which is unauthorised and/or is or may be unlawful.
Email address collection
Generally
If you supply an email address we may collect it to keep in our records for the purpose of communicating with you. Supplying the email address is voluntary but if you do not supply it, the CTTT will not, of course, be able to communicate with you by email.
Email updates and subscription services
The CTTT only sends email updates to people who have given consent (expressed or inferred) to receive it. Once you are on one of our mailing databases, you can easily unsubscribe. each electronic correspondence provides clear instructions on how to unsubscribe.
Spam
Spam is ‘unsolicited commercial electronic messaging’. As part of our commitment to maintaining your privacy, we do not condone or encourage spam. In accordance with the Spam Act 2003, we will only send commercial electronic messages with the addressee's expressed or inferred consent to receive it. All messages will have clear and accurate information about the CTTT as the sender and will have a functional unsubscribe facility. All requests to unsubscribe will be dealt with promptly.
General policy might not apply to online transactions
In some cases, our website permits users to submit information or conduct transactions (for example, submitting online application forms) for legal purposes. Any specific privacy requirements that relate to these online transactions will be explained on the individual page.
Maintaining the policy
Due to the developing nature of privacy principles for online communication, this policy may be changed in light of new developments or issues that may arise from time to time.
