Warrants

When a tenant, co-tenant or resident does not comply with orders to vacate the premises, the CTTT can issue a warrant.  Warrants authorise a Sheriff's Officer to enter the premises and take all steps necessary to remove the tenant/co-tenant/resident from the premises.

How to request a warrant

To request a warrant you should complete a warrant request form.  There are separate warrant request forms for landlords, co-tenants and residential park /retirement village owners or operators.

The warrant request can only be made after the date of possession has passed.  Where orders are made for immediate possession a warrant can be requested once the Tribunal orders are served on the tenant/co-tenant/resident.  Warrant requests must be made within 30 days from the date of possession in the Tribunal orders. 

What do I do with the warrant?

Do not open the envelope addressed to the Sheriff.  Take the envelope unopened to the Sheriff's Office nearest to the premises.

Will the tenant/co-tenant/resident be notified?

Yes.  The tenant/co-tenant/resident will receive a letter advising them that the CTTT has issued a warrant for possession and that they should expect a Sheriff's Officer to turn up at the premises.

How much does a warrant cost?

There is no fee payable to the CTTT to issue the warrant.  However, there are enforcement fees payable to the Sheriff's Office for the service and execution of the warrant.  Contact the Office of the Sheriff for details of their enforcement costs.

How long is the warrant valid?

The warrant must be executed within 28 days from the date it was issued by the CTTT. 

Can I get another copy of the warrant?

The CTTT will only reissue a warrant in the following circumstances.

Warrant opened by mistake
If you open the warrant envelope by mistake this means you have invalidated it and it cannot be executed by the Sheriffs.  To ask for a new warrant you must return the original warrant with your written request to the CTTT.

Warrant lost, misplaced or not received
If you cannot find your warrant or you did not receive it in the post, you can make a written request for another warrant.  You must also include an original statutory declaration with your request.  Faxed requests will not be accepted.

Sheriffs unable to execute warrant within timeframe
Where the Sheriffs are unable to execute the warrant within the 28 day timeframe, such as due to public holidays, unavailability of a Sheriff in regional NSW, or where a rehearing application stay has been lifted, you may request a new warrant.  You must return the original warrant with your written request to the CTTT.
