Enforcing strata and community schemes orders

Enforcing an Adjudicator's orders

A decision made by an Adjudicator is binding.  It is an offence to wilfully contravene or fail to comply with a decision of an Adjudicator.  The CTTT can impose a penalty on anyone who does not comply with the order of an Adjudicator.

To request that a penalty be imposed for the contravention of an order, you must lodge a separate application for penalty orders to the CTTT.

Download a Strata and Community Schemes application form for orders by the Tribunal (PDF size: 387kb).

Enforcing an order to pay money

Write to the Registrar and ask for a certified copy of the order to pay money.  You must take the certified copy to the Local Court nearest to you for enforcement action.
