FAQs - Withdrawals

Listed below are some frequently asked questions (FAQs) about withdrawing an application.  This information is provided as a general guide and should not be treated as legal advice or relied upon as such.

If I withdraw my application, will I get my money back?

No.  The CTTT's application fee is not a hearing or listing fee.  It is a filing fee and is not refunded when an application is withdrawn.

Can I withdraw my application over the phone?

No, you must send a written and signed request.  This may be posted or faxed.

We have now resolved the dispute but I'm not the applicant.  Can I advise the CTTT we no longer need a hearing?

No, only the applicant can withdraw their application.  If you do not receive any advice from the CTTT you must assume that the hearing is still going ahead.

The applicant told me they have withdrawn the application.  How can I tell?

You will receive a notice of order from the CTTT stating that the application is withdrawn.  If you do not receive a notice from the CTTT, you must assume that the hearing will be going ahead.

An interpreter was booked for my hearing.  Who cancels the interpreter?

The CTTT cancels the interpreter service.

Can I withdraw the application on behalf of all the applicants?

If there is more than one applicant, all must confirm their agreement in writing to withdraw the application.  This can be done either on the form or separately.

What happens to the rental bond when the application is withdrawn?

When an application concerning a rental bond is received by the CTTT, the Rental Bond Board is advised that there is an application about the bond currently before the CTTT for determination.  The bond is then retained by the Rental Bond Board until they are provided a copy of the CTTT's final order.

When the application is withdrawn, the CTTT provides a copy of the withdrawal orders to NSW Fair Trading.  The rental bond may then be released as per the original claim form.
