District Court to determine CTTT appeals from 1 September 2008

From 1 September all appeals from a CTTT decision will be heard in the District Court (not the Supreme Court)

This change follows the passage through Parliament of the Courts and Crimes Legislation Amendment Act 2008 which transferred jurisdiction for appeals under section 67 of the Consumer, Trader and Tenancy Tribunal Act 2001, section 108 of the Community Lands Management Act 1989 and section 200 of the Strata Schemes Management Act 1996 to the District Court.

As with the Supreme Court, appeals to the District Court can only be about errors made by the CTTT in applying the law.

What happens to appeals that were filed in the Supreme Court before 1 September 2008?

  • If an appeal was filed in the Supreme Court and allocated a hearing date before 1 September 2008 it will be heard in Supreme Court
  • If an appeal was filed with the Supreme Court but not allocated a hearing date before 1 September 2008, it will be transferred to the District Court.  The District Court will advise parties of the appeal hearing arrangements.
